Mary Chia 30-days Slimming Challenge
TERMS AND CONDITIONS

A. In consideration of the promotion offered by Mary Chia Beauty & Slimming Specialist Pte Ltd (here forth represented by “Mary Chia”) to the Contestant to participate in the Mary Chia Slimming Challenge the Contestant warrants, confirms and agrees with Mary Chia that:

1. The Contestant shall not consume any form of slimming supplement or prescribed appetite suppressant or slimming medication of any manner.

2. To qualify for contest, female customers has to weigh 60kg and above and male customers, 75kg and above.

3. The first package purchased must be at least 70% utilized by the end of 30 days challenge. In the event whereby the first package is not fully utilized, the contestant will be disqualified from the contest in which the decision of the management will be indisputable.

4. Contestants’ slimming results will be tabulated (in kilograms) and recorded starting from the first invoice date.

5. Contestants ‘participation expires 30 days from the first date of invoice.

6. Regardless of female or male contestants , there will be only one winner per round of results announcement.

7. The Contestant irrevocably and unconditionally waives all rights to which he is now or may in the future be entitled in respect of the inclusion of any recorded material any production pursuant to the provisions of the Singapore copyright laws or to the extent permissible pursuant to any other legislation now or in future enacted under the laws in force in any part of the world.

8. Mary Chia shall remain and be the exclusive owner of all rights (including all intellectual property rights) in all publicity materials created for and/ or incorporated into the publicity material and the Contestant shall not assert any right in relation thereto.

9. The Contestant understands, is aware of and accepts the risks involved in his participation in the contest and agrees that Mary Chia shall not be liable for any loss, damage or injury to the Contestant's person or property in whatsoever way arising during or in connection with this Agreement unless caused by Mary Chia's proven gloss negligence.

10. The Contestant understands that he/ she is selected to become one (1) of the winner in this contest: -
a) the Contestant will go through any publicity appearances arranged by Mary Chia.

b) the Contestant will be responsible to record their Diet intake for all their meals.

c) the Contestant agrees to follow strictly the diet/ nutrition plan provided by Mary Chia.

d) the Contestant irrevocably and unconditionally waives all rights to which he/ she is now or may in the future be entitled in respect of the Contestants' testimonials and results for all publicity and collaterals in any form of media over a period of two (2) years from the date of Agreement stated here.

10. The Contestant warrants, undertakes and agrees that: -
a) none of his performances in the Production shall infringe any intellectual property right of a third party;

and

b) He/ she shall not during the term of this Agreement appear in any event/ broadcast telecast/ exhibition in any form, medium or platform of/ for any third party. Where he wishes to appear in any event/ broadcast/ telecast/ exhibition in any form, medium or platform of/ for such third party, he may only do so with Mary Chia's prior written consent;

and

c) he/she has not entered into any contract or arrangement that will interfere in any manner with his obligations under this Agreement;

and

d) he/ she shall not appear or perform in the publicity appearances in a way that would defame or bring Mary Chia into disrepute or that would damage or harm Mary Chia or its image;

11. The Contestant confirms that at the date hereof he/ she has reached his/ her twenty-first (21st) birthday. Where he has not reached his twenty-first (21st) birthday at the date hereof, he/ she undertakes to have his/ her parent or legal guardian (the “Parent”) endorse this Agreement. The Parent, by endorsing this Agreement, hereby consents to the terms of this agreement and agrees with the Contestant to be jointly and severally liable to Mary Chia, and to fully indemnify Mary Chia, for all costs, expenses, losses and damages arising from the Contestant's breach of any of the above provision, warranties, undertakings and/ or covenants.

B. Mary Chia Slimming Challenge is further subjected to the following rules and regulations:-

1. All participants below 21 years of age must, after printing out the terms and conditions/ rules and regulations form, have their parent or legal guardian's consent on the duly signed forms and present them to Mary Chia Beauty & Slimming Specialist Pte Ltd (here forth represented by “Mary Chia”) before the next stage of the contest in order to qualify for it.

2. No employees or immediate family members of an employee of Mary Chia are allowed to enter the contest.

3. Contestants have to comply with all terms and conditions and rules and regulations applicable to the contest. Mary Chia reserves the right to change without prior notice any rules and regulations or the format of the contest at its sole discretion. If any contestant fails to comply with any of the applicable terms and conditions or rules and regulations, he/she will be disqualified immediately.

4. Mary Chia reserves the rights to amend the rules, regulations and proceedings of the contest without prior notice to the contestant. The latest rules and regulations are available from Mary Chia.

5. Mary Chia reserves the absolute right to reject any contestant without having to give any reasons thereof.

C. The management's decisions with regards to all matter of the contest will be final and no correspondence will be entertained.

D. This Agreement shall be governed by and construed in accordance with the laws of Singapore, the courts of which shall be courts of competent jurisdiction.

E. Mary Chia reserves the right to amend contest rules and regulations and contest proceedings without prior notification to the Contestant.

F. The Contestant declares that he/she has read and understood the provisions hereunder and the contest rules and regulations and agrees to be bound by them. In witness whereof, he/she signs this Agreement below. Where the contestant has not attained the age of twenty-one, his parent or legal guardian(“Parent”) shall also sign this Agreement below as evidence of the Parent's agreement to be bound hereby.
